Acceptance of Terms: By accessing the Fresh Catch AA website or placing an order, you agree to comply with the following terms and conditions. If you do not agree, please discontinue use of our site and services. We reserve the right to update these Terms & Conditions at any time by posting revisions on our site, and your continued use after changes are posted constitutes acceptance of those changes.

Eligibility & Account: To register an account or make purchases on our site, you must be at least 18 years old and a resident of Malaysia. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. We may refuse service, terminate accounts, or cancel orders at our discretion if we believe there is a violation of these terms or any fraudulent activity.

Products and Orders: All products listed on our website are subject to availability. Product images and descriptions are for illustration purposes; actual products may vary in appearance or packaging. While we strive for accuracy, we do not guarantee that all product descriptions, pricing, or other content on the site are error-free or complete, and such information is subject to change without notice. By submitting an order through our website, you are making an offer to purchase the selected product(s) under these Terms & Conditions. A binding contract is formed only when we confirm acceptance of your order (e.g. via order confirmation email). We reserve the right to refuse or cancel any order for reasons including errors in product or pricing information, suspicion of fraud, or inability to fulfill the order. In the event of a pricing error or other mistake, we will contact you with the correct information and give you the option to proceed or cancel.

Pricing & Promotions: All prices are listed in Malaysian Ringgit (MYR) and are inclusive of any applicable taxes unless stated otherwise. We may offer promotions such as discounts, coupons, free items, or free shipping from time to time. Such promotions are subject to the terms indicated in their specific offer and may be limited to certain periods or while supplies last. We reserve the right to modify or withdraw any promotion at any time without prior notice. Only one promotional offer or coupon can typically be used per order, unless explicitly allowed by the promotion terms. Any free items or bonuses offered as part of a promotion are not exchangeable for cash or other products. If an order that qualified for a promotion is refunded or partially refunded, we may adjust the value of the promotion accordingly (for example, requiring return of a free gift or reducing a refund by the value of a used coupon if terms were not met).

Payment: We support various payment methods (e.g., credit/debit cards, online banking, or e-wallets) for online purchases. By providing your payment information, you represent that you are authorized to use the payment method and you authorize us (or our third-party payment processor) to charge the full order total to that payment method. Payments must be received in full before we process and ship your order. All transactions on our site are encrypted and processed over secure servers. We do not store your full credit card details on our servers for your protection; payment information is handled by our accredited payment service providers. In case a refund is approved, it will be credited via the same method of payment originally used, whenever possible.

Shipping & Delivery: Currently, we only ship to addresses within Malaysia. We process orders on business days (Monday–Friday, excluding public holidays). Orders for delivery within the Klang Valley area are typically delivered by the next business day after dispatch, while deliveries to other Malaysian states usually arrive within 3–5 business days. (Note: “business day” means Monday to Friday, not including weekends or public holidays.) Delivery times are estimates and may vary due to factors beyond our control, such as courier delays or public holidays. We will do our best to inform you of any significant delays.

We provide delivery updates via email, SMS, or messaging apps (e.g., WhatsApp) to keep you informed of your order status. It is your responsibility to provide a correct and complete shipping address, including any necessary apartment or unit numbers and postal code. Please double-check your address at checkout; we will not be responsible for orders not delivered due to an incorrect address provided by the customer.

You must ensure someone is available at the delivery address to receive the shipment. If no authorized recipient is present at the time of delivery, our delivery team or courier may attempt to contact you to reschedule. We reserve the right to charge an additional fee for redelivery attempts in case of missed delivery. Once delivered to the address you provided, products become your responsibility. We are not liable for any loss or damage to products after they have been delivered, and this includes any deterioration in quality of perishable goods if delivery was missed or not promptly taken in by the recipient. We take care to pack frozen and perishable items appropriately (e.g., with ice packs or insulation), but you should immediately refrigerate or freeze perishable items upon receipt for safety.

Shipping fees, if applicable, will be shown at checkout. From time to time we may offer free shipping promotions (for example, free delivery if your order exceeds a certain amount, or during special campaigns). Any such offers will be clearly stated on our site or during checkout, and they may be subject to conditions (such as a minimum spend or limited to certain delivery areas). Unless a free shipping promotion applies, standard delivery charges will be added to your order total. Currently, we do not offer international shipping; we only deliver within Malaysia.

Returns & Refunds: Due to the perishable nature of seafood and food products, all sales are generally final. We do not accept returns or exchanges for change of mind or taste preference. All goods sold are non-exchangeable, non-returnable and non-refundable unless they fall under specific exceptions as outlined in our Return & Refund Policy. Those exceptions typically cover cases where the product delivered was incorrect, missing, damaged or spoiled upon arrival. Please refer to our detailed Return and Refund Policy below for the conditions and procedures to request a refund or replacement in such cases.

User Conduct: By using our website, you agree to use it only for lawful purposes. You must not misuse the website by knowingly introducing viruses, trojans, worms or other material that is malicious or technologically harmful. You agree not to attempt unauthorized access to any part of the site, the server on which the site is hosted, or any server, computer, or database connected to our site. Any breach of system or network security may result in suspension of your access and, if appropriate, legal action.

Privacy: Your submission of personal information through the site is governed by our Privacy Policy (see below). By using the site or placing an order, you acknowledge that you have read our Privacy Policy and consent to the collection and use of your data in accordance with it. This includes use of your contact information to process orders and to inform you of order status, as well as sending you marketing communications if you have subscribed to our newsletter or given consent for such updates (you may opt out at any time). We are committed to protecting your personal data and complying with applicable data protection laws.

Intellectual Property: All content on the Fresh Catch AA website, including text, images, logos, graphics, icons, and software, is the property of Fresh Catch AA Sdn Bhd or its content suppliers and is protected by intellectual property laws. You may view or print pages from our site for your personal, non-commercial use, but you must not copy, reproduce, republish, upload, or distribute any material from our site without our prior written permission. The Fresh Catch AA name and logo are trademarks of our company, and may not be used in connection with any product or service without our express consent. Any unauthorized use of the site and its content may give rise to a claim for damages and/or be a criminal offense under applicable laws.

Limitation of Liability: While we strive to provide high-quality products and services, Fresh Catch AA Sdn Bhd shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the website or purchase of products. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, regarding the website and the products sold. Our total liability to you for any claim arising from a transaction on our site shall not exceed the price of the product(s) in question that you purchased from us. In other words, if you have a claim regarding a product or delivery, our responsibility will be limited to the amount you paid for that product. Nothing in these terms limits or excludes our liability for any matter that cannot be limited or excluded by law, such as liability for personal injury caused by our negligence or for fraud/misrepresentation.

Indemnification: You agree to indemnify and hold harmless Fresh Catch AA Sdn Bhd and its directors, officers, employees, and agents from any claim or demand (including reasonable attorneys’ fees) made by any third-party due to or arising out of your breach of these Terms & Conditions or your violation of any law or the rights of a third-party.

Governing Law & Dispute Resolution: These Terms & Conditions and any separate agreements whereby we provide you services or sell you products shall be governed by and construed in accordance with the laws of Malaysia. In the event of any dispute or claim related to these terms or your use of our site, we will first seek to resolve the matter amicably through negotiation. If a resolution cannot be reached, the dispute may be referred to mediation or binding arbitration in Malaysia, or to the courts of Malaysia as appropriate. You agree to the exclusive jurisdiction of the courts of Malaysia for the resolution of any disputes that cannot be settled through mutual agreement.

Severability: If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms & Conditions will be effective only if in writing and signed by our authorized representative.
